This Consumer Disclosure and Consent to Use Electronic Records and Signatures (the “Disclosure”) explains your rights when you sign documents electronically through the VG·Sign platform, operated by VG-Real Estate Services Inc. (“VG·Sign”, “we”, “us”). Please read it before you sign. The party that sent you the document (the “Sender”) is responsible for the content of that document; VG·Sign provides the signing technology.
1. Consent to electronic records and signatures
When you proceed to sign, you consent to receive and sign the document — and to receive related notices and disclosures — in electronic form rather than on paper, and you agree that your electronic signature is legally binding.
2. Legal effect
Under the Electronic Commerce Act, 2000 (Ontario) and equivalent Uniform Electronic Commerce Act legislation across Canada, an electronic signature generally has the same legal effect as a handwritten one. The completed document is sealed with a tamper-evident audit trail and a certificate of completion recording who signed, when, and from where.
3. Documents that cannot be signed electronically
Some documents are excluded from electronic signing by law — for example, certain wills and codicils, certain powers of attorney, and certain documents that must be witnessed or notarized in person. Do not use the electronic process for an excluded document. If you are unsure, ask the Sender or seek legal advice.
4. Your right to withdraw consent
You may withdraw your consent to sign electronically at any time before you complete signing, at no penalty, by closing the signing session and notifying the Sender. Withdrawing consent means the document will not be signed electronically through VG·Sign; the Sender may offer an alternative method.
5. Your right to a paper copy
You may request a paper or non-electronic copy of any document you are asked to sign by contacting the Sender. The Sender may set their own fees, if any, for providing paper copies.
6. Hardware and software you need
To access and sign electronically, you need:
- a current web browser on a computer, tablet, or smartphone;
- an active email address (and an SMS-capable phone, if the Sender requires one-time-code verification);
- a connection to the internet; and
- the ability to view, download, and save or print PDF files.
7. Identity verification
You access your document through a unique, single-use signing link sent to your email. The Sender may additionally require a one-time code sent by SMS to your phone. These steps help confirm that the right person is signing and are recorded in the audit trail.
8. Keeping your information current
You are responsible for keeping your contact information (email and, if applicable, phone number) accurate and current with the Sender, so that documents and notices reach you.
9. Retention and access to your signed copy
When signing is complete, you will be able to download the finalized document with its certificate of completion. We recommend you save your own copy. VG·Sign also retains the completed record on the Sender’s behalf in accordance with our Privacy Policy and data-residency practices.
